FORM - XIII [See note under rule 7] FORM OF MORTGAGE BY DEPOSIT OF TITLE DEED This indenture, made this the ______________________ day of _________________19, between Sri_____________________________ ______________________Son of ________________________________ at present employed as ________________________________ in the office of ____________________________________________ at present employed as (hereinafter called the Mortgagor which expression shall included his heirs and other legal representatives) and the Governor of Andhra Pradesh (hereinafter called the Mortgagee which expression shall include his successors in office). Whereas the Mortgagor has applied to the Mortgagee for a loan of Rs._________________ for purpose of purchasing a house site / house / flat in _____________________________as per the rules relating to the payment of advances to the Government employees for house building purposes (hereinafter called the said Rules). And whereas the Mortgagee has passed orders in Prods No.______________ dated __________________ permitting the Mortgagor to deposit his 'title' deeds to secure repayment of the loan granted to him; Now this indenture witnesses as follows :- (1) The title deed mentioned in the Schedule hereto relating to the house/house site at _______________________________ purchased in the name of the Mortgagor Sri/Smt._______________________________________ including the building to the constructed thereon has been delivered to the Mortgagee with intent to create an equitable mortgage upon all the rights, title and interest of the Mortgagor in the said immovable property and all accessions there to secure due repayment on all demands of all moneys which may fall due to the Mortgagee from the Mortgagor on account of 'the' advance or Rs.______________ sanctioned to him together with interest thereon and any costs incurred by the Mortagagee in connection with the recovery thereof.
